When my brother the lawyer got sent to the pokey for 10 days, for the crime of divorce, he switched political parties and ran in the GOP primary. My brother spent $130,000 in six weeks, including a $35,000 8-page political ad that was censored by Knoxville News Sentinel, which cost the judge $40,000 and revealed the judge's prior 'conviction' for being a deadbeat dad.
Seems this judge filed more orders of protection than all other judges in Tennessee combined, which may also mean he jailed more divorcees than all other judges combined.
KNS had no hesitation to report unproven allegations that my brother pulled a Mel Gibson ($15-million criminal extortion by girlfriend after his world-record $320-million divorce), while censoring her diary's confessed sham marriage to win a green card to import her Russian Mafiya "boyfriend/manager" (which resulted in a criminal TERRORIST investigation by Tennessee State Police and US Dept of Homeland Security, unrelated to the divorce). KNS also censored Judge Swann's 2nd wife's allegation that the judge beat her up and broke her arm.
Then my brother's former client, who was also jailed by the same judge in divorce court, and was included in his political ad, sued the judge for $1-million libel in that same election. Jury trial scheduled next week. During the judge's sworn testimony in that case, he confessed to extorting "campaign contributions" from lawyers who had cases scheduled in that court. Judge Swann ordered the lawyers into judge's chambers, then asked them for money, in the middle of that lawyer's trial. As a result of this testimony, TN Court of the Judicial "sanctioned" that judge in a secret hearing, but did not disbar him. Which means all judges probably engage in this extortion racket. This judge refused to answer interogatories on how much his govt paycheck is.

It's interesting that Judge Swann's "First Amendment" lawyer, Dick Hollow, was porno king Larry Flint's personal attorney. As Mr. Hollow told The Dragonator, "I wish I'd never taken this case!"
UPDATE: Judge Swann's jury trial was scheduled to begin Monday, 26 July 2010, but Judge Swann won a continuance after filing a discovery motion 1 day before trial. Anyone else would've been laughed out of court, or thrown in jail for contempt, for failing to move for discovery in the 3 years of this pending case... During Judge Rosenbalm's "ex parte jury orientation" for his other trials on July 26, he forgot to mention that all juries are required by TN Pattern Jury Instructions, and required by US Supreme Court, to judge both the facts AND THE LAW, and juries are required to veto every unconstit6utional law (jury nullification). As superstar lawyer/prosecutor Gerry Spence wrote, a trial lawyer's job is to educate a jury about its power and responsibility of "jury nullification", without using the banned words of "jury nullification". Seems Big Brother wants juries as dumb and illiterate as possible, mere slaves on a leash of its Police State.

Judges routinely ignore the facts and law in cases, and write "orders" ("opinions") without motion from either party, called sua sponte -- "jury nullification by the 13th juror" (the judge). In fact, Judge Rosenbalm pulled his sua sponte trick in court against The Dragonator, but The Dragonator still won.
Note that it's the lawyers' job to object to a judge's or opposition's suggested jury instructions, and instead enforce his own jury instructions. Compare the above suggested jury instruction in civil cases, to the TN Supreme Court's mandatory jury instruction in all criminal cases:

This jury instruction does NOT mean a jury has authority to make up laws that steal constitutionally guaranteed rights, just like judges and legislators has no such authority. This did not stop a runaway judge, runaway prosecutors and runaway jury in Knox County Criminal Court violating The Law and constitutions, by convicting man of "kiddie porn" FOR VIDEOTAPING FULLY CLOTHED ADULTS AT A PUBLIC SWIMMING POOL WHERE HE WAS A RESIDENT.
The judge in Swann's libel case, Judge Wheeler Rosenbalm, previosly told The Dragonator in public court, "You can't use the US Constitution in MY courtroom! Maybe you can go over to federal court and use it, but not here!" The Dragonator won that case anyway, pro se (without a lawyer), using the TN Rules of Evidence (3-year appeal of a $10 parking ticket, parked on The Dragonator's private property, same parking spot The Dragonator's car was stolen from by KPD and it's mafia towing contractors, resulting in 3 class action lawsuits in 3 courts and over 100 towing contractors fired and banned for 5 years).
